Through skillful negotiation, Attorney Richards is able to effect compromises that give homeowners who have repeatedly been turned down a real chance in modifying their mortgages, often obtaining reductions of the principal.

This is no small feat, as a long-standing issue with the mortgage industry is that it does not seem to be bound by law or agreement.

For example, in April of 2012, the Big Five banks signed consent agreements with the US government in which they agreed not to foreclose on property owners in over 49 states without first taking certain preventative measure. They also agreed to pay out a $25 billion dollar settlement to those states. Unfortunately, even as the ink was drying, the banks had resumed “business as usual.”

When the Home Affordable Modification Program bill known as HAMP came into effect, Attorney Leslie Richards was one of the first people to speak out against its biased nature. It was, “Banks 99, owners 1–if they were lucky,” she stated.

New laws were then passed in California–supposedly created to help homeowners and make it more difficult for banks to foreclose on them. But Attorney Richards was one of the first to say that the only thing new law was going to do was to “help the legislators get re-elected.” According to Richards, the laws were simply smoke and mirrors designed to appear like a life boat while only dragging the owner further out into the dark sea of foreclosure.

Now, in 2013, it finally appears that the State of California has put some teeth into these laws. With the Homeowner’s Bill of Rights and other available recourse, property owners have a chance of preventing the bank from easily skirting the laws. Attorney Richards says this with cautious optimism as the new law took effect on January 1st and ultimately, only time will tell.
